Several potential jurors in the trial of Michl D. Uhde versus the Diocese of Davenport said Monday they don’t agree that a person should be able to bring a lawsuit years later.
Jury selection in the civil trial began Monday morning in Scott County District Court, but by 5 p.m., only two jurors were seated. District Court Judge Charles H. Pelton sent the 62 home for the day. Eight jurors and three alternates are needed.
Uhde filed his suit in July 2005, listing Monsignor Thomas Feeney as a defendant along with the diocese, claiming he was abused almost 50 years ago. Feeney died July 27, 1981, after retiring earlier that year.
During questioning, jurors were asked if they had seen news reports or church bulletins referring to the case. Some Catholics on the jury panel said they had some knowledge of Uhde’s lawsuit.
One woman was dismissed after learning that her pastor was on the witness list. She said she didn’t think she could listen to his testimony and remain impartial.
Rand Wonio, a Davenport attorney who represents the diocese, asked jurors if they understand what repressed memories and the statute of limitations are.
Several jurors said they didn’t agree with the idea that a litigant can bring a case to court years later. Those jurors said they would try to abide by the court’s instructions but thought it would be difficult.
