Mr Scully claims Mr Smith has an ongoing conflict of interest attempting to fulfill his duties as deputy DPP, while simultaneously attacking the Government in his role as a Liberal candidate.

Brandishing a pamphlet in which Mr Smith claimed the Government was soft on crime, Mr Scully said "nothing could be more of a conflict of interest than that".

Earlier this month, Mr Smith defeated federal Sex Discrimination Commissioner Pru Goward for Liberal preselection in the blue-ribbon seat of Epping, in northwest Sydney.
